REGULAR CITY COUNCIL MEETING

CITY OF GATESVILLE

OCTOBER  28, 2008

COUNCIL CHAMBERS, 110 NORTH 8TH STREET

5:30 P. M.

PRESENT:  Mayor Byrom, Council Members Woodlock, Knox, Chumley, Cain, and Inmon

ABSENT:  Council Member Wasson

OTHERS PRESENT: City Manager Roger Mumby, Assistant City Manager Luis Lobo, City Attorney Sandra Gately, Marie Dominquez, Brian Myers, Adrian Costelo, Holly Jones, Bill Trotter, Sheila Trotter, Barbara Williams, Frank Williams, Kyle A. AN OPEN MEETING WAS HELD CONCERNING THE FOLLOWING SUBJECTS:

1)     CALL TO ORDER AT 5:35 P.M., THIS 28th  DAY OF OCTOBER, 2008

2)     PROOF OF NOTICE AND POSITNG OF COUNCIL MEETING AGENDA

Mayor Byrom directed a question to Assistant City Manager Luis Lobo if the notice of the Meeting was posted at the proper place and time pursuant to the Texas Opening Meeting Act (Tex. Rev. Civ. Stat. Ann., Art 6252-17) Vernon’s Supp. 1990.  Assistant City Manager assured Mayor Byrom that the notice was posted at the proper place.

3)    APPROVAL OF MINUTES FROM PREVIOUS MEETING

Motion  by Knox, seconded by Cain, all voting “aye” to approve Resolution Number 2008-118

RESOLUTION NUMBER 2008-118 –approve minutes of the October 14, 2008 Regular City Council Meeting.

4)   HEAR VISTORS

Ms Dona Gallagher approached the council with concern on city public water crews providing service to a water problem “fast enough”.  City Manager Mumby explained to the Council that several other water and sewer problems were being worked on and that issue at hand was not over looked.

5)    HEAR RECOMMENDATIONS FROM CITIZENS AGAINST DRUGS

Mr. Kyle Powell provided the council with information that Gatesville is not the number one city in Texas with a drug problem.   He was concerned about rumors that would give Gatesville a negative name among its citizens.  Several citizens came before the council to express their concern of drug problems in the area and used their personal experiences as a benchmark.

Police Chief Nathan Gohlke explained to the council some of the activities that the local police department were using to fight the drug problem.

Mayor David Byrom thanked the persons for their concern and he believes that citizens as volunteers can work with the police department together to solve problems.
 
6)    RECESS REGULAR MEETING AND CALL A -------------------------------

Public  Hearing

Hear comments concerning a request to change the zoning at Lot 2, Block 2 Valley View Addition from the Residential Single Family Zoning District to the Residential 2-4 Family Zoning District

City Manager Roger Mumby made the presentation on this issue.  Mr. Mumby informed the council of the Planning and Zoning Commission reviewing this matter and they voted to change the zoning from Single Family to Residential 2-4 Family Zoning.

7)     END THE PUBLIC HEARING AND RECONVENE THE REGULAR MEETING

8)   CONSIDER THIRD AND FINAL READING OF ORDINANCE NUMBER 2008-14 AMENDING CHAPTER 7, CODE OF ORDINANCE OF THE CITY OF GATESVILLE, TEXAS BY CHANGING THE GARBAGE RATES

City Manager Roger Mumby explained to the council that through contractual agreement Waste Management is requesting the yearly increase of garbage rates using the Consumer Price Index.   There are no changes to the previous two readings.

Motion by Knox, seconded by Woodlock , all voting “aye” to approve Resolution Number 2008-120.

RESOLUTION NUMBER 2008-120 -     approve third and final reading of Ordinance Number 2008-14 amending Chapter 10, Garbage and Trash Collection charges Section10-7, Code of Ordinance of the City of Gatesville, Texas by changing the garbage rates using the Consumer Price Index percentage as point of reference.

9)  CONSIDER SECOND READING OF ORDINANCE NUMBER 2008-15
REGULATING THE RATE AND SPEED OF MOTOR VEHICLES ON A CERTAIN SECTION OF US HIGHWAY 84

Ms.  Marie Dominquez expressed her views on this issue.  The council had a discussion on this matter.

Motion by Knox, seconded by Cain, all voting “aye” to approve Resolution Number 2008-121.

RESOLUTION NUMBER 2008-121 – approve second reading of Ordinance Number 2008-15 regulating the rate and speed of motor vehicles on a certain section of US Highway 84.

10)  CONSIDER FIRST READING OF ORDINANCE NUMBER 2008-16
AMENDING THE ZONING ORDINANCE BY CHANGING LOT 2 BLOCK 2 VALLEY VIEW ADDITION FROM THE RESIDENTIAL SINGLE FAMILY ZONING DISTRICT TO THE RESIDENTIAL 2-4 FAMILY ZONING DISTRICT

Motion by Inmon, seconded by Knox, all voting “aye” to approve Resolution 2008-119.

RESOLUTON NUMBER 2008-119 –approve on the first reading the proposed request to change the zoning at Lot 2, Block 2, Valley View Addition from Residential Single Family District to the Residential 2-4 Family Zoning.

11) CONSIDER APPROVAL OF RESOLUTION APPROVING A CHANGE IN
THE TARIFFS OF ATMOS ENERGY CORPORATION, MID-TEX DIVISION AS
ARESULT OF A SETTLEMENT BETWEEN ATMOS AND THE ATOMS TEXAS
MUNICIPALITIES (ATM)

Assistance City Manager Luis Lobo gave presentation on the new rate changes of Atmos Energy Corporation, Mid-Tex Division.  The new system is a result of a settlement between Atmos and group of cities (Atmos Texas Municipalities/ATM) that joined together to review the rates and new system.   

Motion by Chumley, seconded by Knox, all voting “aye” to approve Resolution Number 2008-122.

RESOLUTION NUMBER 2008-122 approve the change in the tariffs of Atmos Energy Corporation, Mid-Tex Division as a result of a settlement between Atmos and the Atmos Texas Municipalities (ATM).

12)    CONSIDER APPROVAL OF RESOLUTION TO SUPPORT RAISE YOUR HAND TEXAS

Motion by Knox, seconded by Cain, all voting “aye” to approve Resolution Number 2008-123.

RESOLUTION NUMBER 2008-123 – support the Raise Your Hand Texas project.

13)  CONSIDER SETTING NOVEMBER 10, 2008 AS THE DATE FOR THE
FIRST CITY COUNCIL MEETING IN NOVEMBER

City Manager Roger Mumby asked the council to move the regular city council meeting from November 11, 2008 to November 10, 2008.  Mr. Mumby explained that November 11, 2008 is Veterans Day and it is a city holiday.

Motion by Inmon, seconded by Woodlock, all voting “aye” to approve Resolution Number 2008-124.

RESOLUTION NUMBER 2008-124 – approve moving the regular city council meeting from November 11, 2008 to November 10, 2008 due the Veteran Day holiday.

14)     CITY MANAGER REPORT

City Manager Mumby presented the council an update on the following city projects:

North Fort Hood sewer project—the city has provide a draft of a billing form to the US Army for their review & construction is coming to an end on this phase of the project.

Phase II of North Food Hood sewer project is close to beginning.

The Gatesville Regional Water Plant modernization project has begun with the installation of a new SCADA system.  The time period needed to install the SCADA system is 240 days.

HOME grant is has reached a point where applicants are being contacted as to their qualification.

The Splash Park grant project is in the preliminary status.

The Indoor grant is being reviewed by the Texas Parks and Wildlife Department.  Several of the local banks have expressed an interest in assisting, along with some private contractors, and the Texas Department of Criminal Justice.
   
15)     POLICE DEPARTMENT REPORT

Police Chief Nathan Gohlke expressed his willingness for the police department to work with the citizens of Gatesville so solve problems in the community.

This close meeting is in accordance with Government Code 551.071-Consultation with Attorney

21)    CONSIDER ANY ACTION REQUIRED FROM EXECUTIVE SESSION CONCERNING CONSULTATION WITH ATTORNEY

    No action is necessary at this point.
