REGULAR CITY COUNCIL MEETING

 

MAY 22, 2012

 

5:30 P.M.

 

COUNCIL CHAMBER, 110 NORTH 8TH STREET

 

PRESENT:    Mayor Byrom, Council Members Chumley, Woodlock, Viss,  Inmon, and Burrow

 

 ABSENT:   Councilmember  Shepherd-Cain

 

OTHERS PRESENT:  City Manager Roger Mumby, Assistant City Manager Luis Lobo, City Secretary Wendy Cole, Larry Kennedy, Nathan Gohlke, Liz Reinhardt, William Coalston , Brenda Kiphen, Bassel Leach, Carol Leach, Robert Featherston, Billy Vaden and Michael Gohlke

 

AN OPEN  MEETING WAS HELD CONCERNING THE FOLLOWING SUBJECTS

 

1)  CALL TO ORDER AT  5:35 P.M., THIS  22nd  DAY OF  MAY, 2012

 

2)  PROOF OF NOTICE AND POSTING OF COUNCIL MEETING AGENDA

 

Mayor David Byrom directed a question to  City Secretary Wendy Cole if the notice of the meeting was posted at proper place and time pursuant to the Texas Opening Meeting Act (Tex. Rev. Stat. Ann. Art. 6252-17) Vernon's Supp. 1990.  City Secretary Wendy Cole assured Mayor David Byrom the notice  was posted at the proper place and time.

3)  APPROVAL OF MINUTES FROM PREVIOUS MEETING

 

Motion by Viss, seconded by Woodlock, all voting "Aye" to approve Resolution Number 2012-48

 

RESOLUTION NUMBER 2012-48   -  approve Minutes of  May 8, 2012  Regular City Council Meeting.

 

4)    RECOGNIZE RETIRING EMPLOYEE BASSEL LEACH

 

Mayor David Byrom presented retiring Employee Bassel Leach with a plaque and thanked him for his service and dedicated support to the citizens of Gatesville.  Bassel is retiring after twelve years of service to the City of Gatesville and the Mayor and councilmembers wished him a great retirement.

 

5)   HEAR VISITORS

 

Visitors present were only concerned with an Agenda item.

 

6)    CONSIDER DONATION OF 711, 713, AND 715 MAIN  STREET TO THE CITY

   

City Manager Mumby reviewed the Council on the consideration of the property owners donating 711, 713, and 715 Main Street to the City.  Both property owners indicated that they would just donate the properties to the City.  The City staff estimates that it would cost approximately one hundred thousand dollars to remove the asbestos and demolish the buildings.  City Manager Mumby suggested that the Council accept the property owners offer and perform a title search and obtain title insurance.  If the Council would agree to this transaction then the project would be needed to be spread out over two fiscal years to figure out how to fund all of it.  The question was asked if both 711 and 713 Main Street definitely had asbestos in them and City Inspector Robert Featherston said that yes both structures were tested and have come back “hot” for asbestos.  There was a lengthy discussion and the following points were discussed:

  • Putting liens on properties
  • Leaving the properties alone and then dealing with safety issues      as they come up
  • If the property owners sought out other buyers
  • If  this action would be      setting a precedent
  • Legal battles over condemnation
  • Obtaining and owning property through tax sales
  • Code Enforcement
  • If this action is something the City can afford
  • Concern of spending money on something that possibly has no value

 

Mayor Byrom stated that there were no guarantees regarding the outcome of this decision but that the Council needed to decide what is the right thing to do for the City of Gatesville.  Mayor Byrom said that this project may not be something of value concerning revenue for the City but that it is good for the community and is the right thing to do.

 

Motion by Woodlock, seconded by Inmon. Woodlock, Inmon, and Chumley voted  "Aye”.  Viss and Burrow voted “Nay” to approve Resolution Number 2012-49

 

RESOLUTION NUMBER 2012-49   -  approve donation of 711, 713 and 715 Main Street to the City of Gatesville and approve authorization for the City Staff to request bids for asbestos removal and demolition.

 

7)    CONSIDER A TAX ABATEMENT AGREEMENT WITH THE OWNERS OF HEIL TRAILER INTERNATIONAL COMPANY

 

City Manager Mumby stated that Heil Trailer has requested in writing a tax abatement for two hundred seventy five thousand dollars to invest on new equipment for the plant in Gatesville.  City Manager Mumby recommends that the Council accept  this proposal to prove that the City is Development Friendly.  The City of Gatesville Tax Abatement Program supports their request. Councilmember Chumley indicated that Heil’s Taxation chart differed slightly from what the City’s Abatement chart has.

 

City Manager Mumby said that is what Heil Trailer is proposing and he suggests that the Council support their request but to use what is in the City’s guidelines.  If the Council agrees to the concept of their proposal the request would need to follow the City of Gatesville’s guidelines.

                       

Motion by Inmon, seconded by Burrow, all voting “Aye” to approve Resolution Number 2012-50

RESOLUTION NUMBER 2012-50  - approve a Tax Abatement Agreement with the owners of Heil International Company and authorize the Mayor to sign the resolution.

 

8)   UTILITY DEPARTMENT REPORT

 

William Coalston presented his monthly report on the street and  park departments.  He stated that lately there have been no inmates to assist with the mowing and so his crew has been doing all the mowing which takes up a lot of time.  The Council commended William on the success of the Spring Clean-up.  Many citizens commented on how smooth it went.

 

9)    FINANCE DEPARTMENT REPORT

 

Finance Director Brenda Kiphen presented the Finance Report.  There was a brief discussion regarding the Airport Fuel and City Manager Mumby indicated that the City just tries to break even on the gas with the thought that this would encourage people to use the City of Gatesville’s airport.

 

10)    FIRE DEPARTMENT REPORT

 

Fire Chief Billy Vaden discussed the Fire Department Report.  He also reported that grass fires are picking up.  Hay fields and Hay Balers are catching fire.  FEMA is going to audit the fire department before they can receive their requested funds.  Starting the second week in June the Fire Department will start testing the many fire hydrants in town and will report the results back to the Council.

 

11)  POLICE DEPARTMENT REPORT

 

Police Chief Nathan Gohlke presented the Police Department Report.  Reported that last week the Police Department went through its annual Taser Training.

 

12)   CODE ENFORCEMENT AND BUILDING PERMIT  REPORT

 

Zoning Official Liz Reinhardt presented the Code Enforcement Report and Zoning actions as well as the Building Permit Report.

 

13)  CITY  MANAGER’S REPORT

 

----  Stated that the City has started the process of renegotiating the Wastewater Contract with North

       Fort Hood.  They are not paying enough to cover the debt service.  They owe approximately four

       hundred thousand right now which would get them back on schedule.

 

----  Planning to meet with Fort Hood regarding the North Fort Hood Wastewater Treatment for the

       Operational Ready Training Complex they are planning to build this summer.  The City disagrees

       with the Fort Hood Engineers regarding the amount of waste the lift stations can handle.  The

       collection system needs to be expanded with an estimated amount of two million dollars worth of

       bonds.

 

----  HOME Program is at 3 houses right now with the title searches nearly done and should be getting a

        total of four done soon. 

 

----   The T- Hangars are up and are getting roofs now.  The ramps will begin to be paved this week. 

        Possibly to have a grand opening in June.

 

----   The new pavilion will rent for thirty-five dollars per day and many people have already shown

         interest in renting it.

 

----   The Disk Golf Course will have the baskets put in the ground next week.

 

----   The Splash Park opened May 1st and the swimming pool will open June 2nd and there are already

        several parties booked.

 

----   City Manager Mumby provided a Power Point presentation regarding the Rules and Regulations at

         the Restland Cemetery.

        He explained that the cemetery has become cluttered with items that distract from the appearance

        and make it difficult to maintain.  The rules and regulations are given to family members when they

        do buy a plot but it was also suggested to give the rules to the two funeral homes to give to families

        also.

 

        City Manager Mumby thought a respectable approach could be to write letters to suggest that the

        areas need to be cleaned up and then give them a time frame to get it done.

 

        Councilmember Woodlock suggested putting the rules and regulations in the newspaper as a

        reminder to the citizens.  All the councilmembers agreed it was a great idea.  The councilmembers

        were encouraged to give their input since this is such an emotional topic.  There was more

       discussion and the members agreed to table this subject right now for more thought and to discuss at

       a later meeting.

 

----  Barbara Burrow said she would like to put on the next agenda for consideration  a plan to organize    

        an  Economic Development Commission.

 

----  Extending the runway was discussed

 

----  Reported that the City of Gatesville officially owns the Civic Center.  The contract has been signed.

 

----  Discussed the length of the Hike/Bike Trail.
