REGULAR CITY COUNCIL MEETING

 

FEBRUARY 12, 2013

 

5:30 P.M.

 

COUNCIL CHAMBER, 110 NORTH 8TH STREET

 

PRESENT:       Mayor Byrom, Council Members, Chumley, Woodlock,  Inmon, Shepherd-Cain and Burrow

                 

REGRETS:    Councilmember Ronnie Viss

 

OTHERS PRESENT:  City Manager Roger Mumby, Assistant City Manager Luis Lobo, City Attorney Sandy Gately,  City Secretary Wendy Cole, Larry Kennedy,  Robert Featherston, Bret Necessary, and Paulette Price

 

AN OPEN  MEETING WAS HELD CONCERNING THE FOLLOWING SUBJECTS

 

1)  CALL TO ORDER AT  5:30  P.M., THIS 12th  DAY OF  FEBRUARY, 2013

 

2)  PROOF OF NOTICE AND POSTING OF COUNCIL MEETING AGENDA

 

Mayor Byrom directed a question to  City Secretary Wendy Cole  if the notice of the meeting was posted at proper place and time pursuant to the Texas Opening Meeting Act (Tex. Rev. Stat. Ann. Art. 6252-17) Vernon's Supp. 1990.  City Secretary Wendy Cole  assured Mayor Byrom  the notice  was posted at the proper place and time.

3)  APPROVAL OF MINUTES FROM PREVIOUS MEETING

 

Motion by Woodlock, seconded by Chumley, all voting "Aye" to approve Resolution Number 2013-12

 

RESOLUTION NUMBER 2013-12     -  approve Minutes January 22, 2013 Regular City Council Meeting.

 

4)    RECOGNIZE EMPLOYEE OF THE MONTH

 

Mayor Byrom congratulated Robert Featherston, the City of Gatesville’s Building Inspector for being  selected as Employee of the Month for January 2013.  Mayor Byrom thanked Robert for the many tasks that he accomplishes as well as being a volunteer fireman.  Mayor Byrom thanked Robert Featherston for his continuing support to Gatesville and it’s citizens and recognized him for his exceptional performance.

 

5)     HEAR VISITORS    

 

Gatesville citizen, Paulette Price approached the Council to commend City Building Inspector, Robert Featherston for a job well done.  She said that Mr. Featherston went out of his way to help her with a problem and he resolved it for her.  She said he was a kind and professional employee and when she found out from City Manager Mumby that Mr. Featherston was being recognized as the Employee of the Month she wanted to let the City Council know what a wonderful person he is.  She thinks he deserves to be Employee of the year.  Mayor Byrom thanked Ms. Price for taking the time to come to the City Council Meeting to tell them positive comments about Robert.

 

6)    CONSIDER SECOND  READING OF ORDINANCE NUMBER 2013-01 REPEALING ORDINANCE NUMBER   2003- 02 AND ADOPTING A DROUGHT CONTINGENCY PLAN 2013 FOR THE CITY OF GATESVILLE

City Manager Roger Mumby stated that this was the second reading of Ordinance Number 2013-01 to adopt the drought contingency plan for the City and there were no changes since the first reading on January 22, 2013.

 

Motion by Inmon, seconded by Shepherd-Cain, all voting “Aye” to approve resolution Number 2013-13

 

RESOLUTION NUMBER 2013-13   -  approve second reading of Ordinance Number 2013-01 repealing Ordinance Number 2003-02 and adopting a Drought Contingency Plan 2013 for the City of Gatesville.

 

7)    CONSIDER APPROVAL OF PAY REQUEST #6 FROM NATGUN FOR THE WATER TANK IMPROVEMENT   PROJECT

 

City Manager Roger Mumby told the Council that this project is on track and Walker Partners has reviewed this request and recommends approval of this sixth payment of $529,274.07.

 

City Manager Mumby stated that the project was more than fifty percent completed and so far there was one change order which was to paint the adjoining tanks and there could possibly be a few more changes.

 

Bret Necessary of Walker Partners was present at the meeting and he explained to the Council that there would be enough funds to do these changes.

 

Motion by Burrow, seconded by Woodlock, all voting “Aye” to approve resolution Number 2013-14

 

RESOLUTION NUMBER 2013-14  -  approve Pay Request #6 from Natgun for the Water Tank Improvement Project in the amount of $529,274.07.

 

8)    CONSIDER APPROVAL  OF AWARDING THE STILLHOUSE WASTEWATER TREATMENT PLANT HEADWORK’S    RENOVATION BID

      

City Manager Roger Mumby stated that the City of Gatesville was awarded a Community Development Block Grant to reduce solids at the Stillhouse Wastewater Treatment Plant.  The City staff advertised for bids and received five bids for the grit and solids removal system for the Stillhouse Plant.  The bids ranged from $249,000 to $299,000.  The low bidder was JKB Construction Company from Leander, Texas at $249,000.  Walker Partners has checked their references and recommends awarding the bid to JKB Construction.

 

Motion by Shepherd-Cain, seconded by Woodlock, all voting “Aye” to approve Resolution Number 2013-15

 

RESOLUTION NUMBER 2013-15  -  approve awarding the bid for the Stillhouse Wastewater Treatment Plant Headwork’s Renovation Bid to JKB Construction Company, LLC.

 

9)    CITY  MANAGER’S REPORT

 

City Manager Roger Mumby reported on the following:

 

---  Demolition for the new library addition is now underway.

 

---  Renewal of the Waste Management solid waste collection contract automatically renews every five

      years unless either party gives written notice of termination at least 30 days prior to the anniversary

      date.  The next renewal date is October 1, 2016.

 

---  Discussed how sales tax revenue is recognized out of alcohol sales.  The first three years that an

      organization or business pays, stays with the Texas Alcoholic Beverage Commission.  The City

      won’t see any increase in sales tax revenue until the fourth year after the City can apply for the sales

      tax.  Also discussed was the fact that the mixed beverage tax percentage that the City received was

      reduced from 10.7143% to 8.0365% in 2011.  Mr. Mumby explained that the tax on package alcohol

      sales is taxed at the local tax rate of 8.25% and the City gets 1.5%.  This tax is included in the total

      sales tax numbers for a particular store and is not broken out as alcohol tax.

---  City Attorney Sandy Gately reported that the City of Gatesville received a check last week in the

      amount of $16,552.81 for an Atrazine Class Action Settlement lawsuit.

 

---  Councilmember Shepherd-Cain asked where this money would be placed and City Manager Mumby

      answered that it would be put in the General Fund.
