Chapter 1- General Provisions


 

Sec. 1-1. How Code designated and cited.

 

            The ordinances embraced in this and the following chapters and sections shall

            Constitute and be designated the “Code of Ordinances, City of Gatesville,

            Texas” and may be so cited.

           

            CHARTER REFERENCE-- Authority to codify ordinances, Sec. 3.11 (c).

            STATE LAW REFERENCE--Authority to adopt a civil and criminal code of

            Ordinances, V.T.C.A., Local Government Code § 53.001.

 

Sec. 1-2. Catch lines of sections.

 

           The catch lines of the several sections of this Code printed in boldface type are             

           intended as mere catchwords to indicate the contents of the section and shall

           not be deemed or taken to be titles of such sections, nor as any part of the

           section, nor, unless expressly so provided, shall they be so deemed when any of

           such sections including the catch lines, are amended or reenacted.

 

Sec. 1-3. Rules of construction

            In the construction of this Code, and of all ordinances and resolutions       passed by the city council, the following rules shall be observed, unless such construction would be inconsistent with the manifest intent of the city council.

            GENERALLY.           Words shall be construed in their common and usual significance unless the contrary is clearly indicated.

            CITY.  The words “the city” or “this city” shall mean the City of Gatesville in the County of Coryell and State of Texas.           

 

CITY MANAGER, CITY SECRETARY, CHIEF OF POLICE OR OTHER CITY

OFFICERS. The words “city manager,” “city secretary,” “chief of police,” or other City officers or departments shall be construed to mean the city manager, city secretary, chief of police or such other municipal officers or departments,

respectively,,of the City of Gatesville, Texas, and their duly authorized deputies, assistants, and representatives.

COMPUTATION OF TIME.       Whenever a notice is required to be given or an act to be done a certain length of time before any proceeding  shall be had, the day on which such notice is given or such act is done shall be counted in computing the time, but the day on which such proceeding is to be had shall not be counted.

  1. Whenever the words “council” or “this council” or “the council” is used, they shall mean the city council of the City of Gatesville, Texas.

COUNTY.      The term “county” or “this county” shall mean the County of Coryell, Texas.         

GENDER.      A word importing the masculine gender only shall extend and be applied to females and to firms, partnerships, associations and corporations as well as to males.

MONTH.         The word “month” shall mean a calendar month.

  1. Any word importing the singular number shall include the plural and any word imparting the plural number shall include the singular.

OATH.            The word “oath” shall be construed to include an affirmation             in all cases in which, by law, an affirmation may be substituted for an oath, and in such cases the words “swear” and “sworn” shall be equivalent to the words “affirm” and “affirmed.”

  1. The word “owner,” applied to a building or land, shall include any part owner, joint owner, tenant in common, tenant in partnership, joint tenant or tenant by the entirety of the whole or of a part of such building or land.
  2. The word “person” shall extend and be applied to associations, corporations, firms, partnerships and bodies politic and corporate as well as to individuals.

PRECEDING, FOLLOWING.         The words “preceding” and following” mean next before and next after, respectively.

SIGNATURE OR SUBSCRIPTION.     The word “signature” or “subscription” shall include a mark when a person cannot write. 

  1. The words “the state” or “this state” shall be construed to mean the State of Texas.
  2. Words used in the past or present tense include the future as well as the past and present.

             WRITTEN OR IN WRITING.           The term “written” or “in writing” shall be  construed to include any representation of words, letters or figures, whether by printing or otherwise.

            YEAR.            The word “year” shall mean a calendar year.

Sec. 1-4. Amendments or additions to Code.

            All ordinances passed subsequent to this Code which amends, repeal or in any way affect this Code may be numbered in accordance with the numbering system of this Coded and printed for inclusion therein. When subsequent  ordinances repeal any chapter, section or subsection or any portion thereof, such repealed portions may be excluded from the Code by omission from reprinted pages.

            Amendments to any of the provisions of this Code may be made by amending such provisions by specific reference to the section number of this Code  the following language: “That section ______ of the Code of Ordinances,  City of Gatesville, Texas, is hereby amended to read as follows:....” The new  provisions shall then be set out in full as desired. 

            In the event a new section not heretofore existing in the Code is to be added, the following language may be used: “That the Code of Ordinances, City  of Gatesville, Texas, is hereby amended by adding a section, to be numbered________,  which said section reads as follows:....”  The new section shall then  be set out in full as desired.

Sec. 1-5. Severability of parts of Code.

            It is hereby declared to be the intention of the city council that the section, paragraphs, sentences, clauses and phrases of this Code are severable and, if any phrase, clause, sentence, paragraph or section of this Code shall be declared unconstitutional or invalid by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality invalidity shall not affect any of  the remaining phrases, clauses, sentences, paragraphs and sections of this code since the same would have been enacted by the city council without the incorporation in this Code of any such unconstitutional or invalid phrase, clause, sentence, paragraph, or section. 

Sec. 1-6. General penalty for violations of Code; continuing violations.

            Whenever in this Code or in any ordinance of the city an act is prohibited or is

         declared to be unlawful or an offense or a misdemeanor, or wherever in such

           Code or ordinance the doing of any act is required or the failure to do any act is

           declared to be unlawful, and no specific penalty is provided therefore the

           violation of any such provision of this Code or any such ordinance shall be

           punished by a fine of not more than one thousand dollars ($1,000.00); provided,

           however, that no penalty shall be greater or less than the penalty provided for the

           same or a similar offense under the laws of the state.  Each day or fractional part

         therefore that any violation of this Code or of any ordinance shall continue shall

           constitute a separate offense.  (Ord. No. 84-16, 7-24-84, Sec. 1) STATE LAW

Sec. 1-7. Extraterritorial jurisdiction expanded.

            The extraterritorial jurisdiction of the city is hereby expanded to include the   following real property:

            All that certain tract or parcel of land situated south-east of Gatesville, in    Coryell County, Texas, containing 160 acres of land, more or less, out of         the A.

           Arocha Survey, Abstract No. 8, and described further as follows:

            BEGINNING at a rock pile the NE corner of Block No. 9, from which a Post Oak

           brs N 8-1/2 W 14 links;

            THENCE S 19 W 4000 links a corner, a Live Oak brs N 78 W 150 links;

            THENCE N 71 W 4000 links a corner;

            THENCE N 19 E 4000 links a corner in the north line of said original          survey;

            THENCE S 71 E with north boundary line at 2500 links crosses Arrowood             Branch, in all 4000 links to the place of beginning, containing 160 acres of            land,

          More or less, and being the same land received by Nona Maude Jones from the

           Estate of Elizabeth R. Bigham as shown and recorded in Vol. o, Pages 148, 149

           Probate Minutes of the County Court of Coryell,Texas.

            SAVE AND EXCEPT about one (1) acre previously sold near the northeast

           corner for a school house and a small strip heretofore conveyed to G.B. Carden

           situated on the north side of the public road; and

          SAVE AND EXCEPT 9.394 acres conveyed to the State of Texas for right-  of-way

          purposes shown  and recorded in Vol. 134, Page 431 of the Deed Records of

          Coryell County, Texas; and

            SAVED AND EXCEPT 0.138 acre previously sold to the Fort Gates water Supply Corporation as shown and recorded in Vol. 240, Page 261 of the Deed

Sec. 1-8. Extraterritorial jurisdiction expanded.

            The extraterritorial jurisdiction of the city is hereby expanded to include the           following real property:

           Being the property more fully described as the “Final Plat Phase Two” of that        certain 13.926 acres which have been subdivided into 35 lots with such Plat being recorded under Clerk’s File No. 102664, Cabinet A, Slide 419 of the Plat records of Coryell County, Texas, consisting of Block 1 composed of 8 lots, Block 2 composed of 16 lots, Block 3 composed of 11 lots, and a utility easement and common area, together with streets named Stoneridge Drive, Greenlawn Drive, and Spyglass Drive, more particularly described as follows, and adopting a service plan for this annexed area:

A tract of land in Coryell County, Texas, part of the E. Norton Survey, Abstract No. 782 and the land herein described being a part of that certain 186.5 acre tract of land surveyed by Fred Williamson, registered Public Surveyor, on September 3, 1971, and described by Field Notes for Vivian A. McCreary, being of record in Volume 288, Page 604, Deed Records of Coryell County, Texas, and being a part of the same land conveyed by Vivian A. McCreary to J.H. Arnold et al by various deeds of record in Volume 288, Pages 605-645, Deed Records of Coryell County, Texas.

            BEGINNING at a fence post that bears N. 89 deg. 03’59” E., 571.46 feet     and S. 00 deg. 50’31” W., 122.05 feet, from the most westerly southwest        corner of said 186.5 acre tract, and said post being the northwest corner           of 0.9 acre City of Gatesville tract and being a corner of said 186.5 acre tract, for the most westerly southwest corner of this;

            THENCE with the north line of said 0.9 acre tract, S. 89 deg.22’02” E.,        179.23 feet, to a fence post being the northeast corner of said 0.9 acre tract for a corner of this;

            THENCE with the east line of 0.9 acre tract, S. 00 deg. 44’16” W., 200.57   feet, to a fence post in the north right of way of U.S. Highway 84, for the         most southerly southwest corner of this;

            THENCE with said north right of way, S. 82 deg. 21’43” E., 104.42 feet, to a concrete monument found and S. 81 deg. 11’54” E., 335.83 feet, to a           3/8” iron rod found, for a corner of this;

            THENCE N. 89 deg. 52’38” E., 27.50 feet, to a 3/8” iron rod found being     the southwest corner of a 20.00 acre tract as described in the field notes prepared by James B. Burleson for Jasper H. Arnold III, for the southeast corner of this;

            THENCE with the west line of said 20.00 acre tract, N. 00 deg. 43’44” E., 904.59 feet, to a #60 spike found being the northwest corner of said 20.00 acre tract, for a corner of this;

            THENCE N. 00 deg. 29’51” E., 250.00 feet, to a 3/8” iron rod set, for the northeast corner of this;

            THENCE N. 89 DEG. 30’09” W., 330.00 feet, to a 3/8” iron rod set, for the most northerly northwest corner of this;

            THENCE S. 00 deg. 29’51” W., 250.00 feet, to a 3/8” iron rod set, for a corner of this;

            THENCE N. 89 deg. 30’09” W., 335.00 feet, to a 3/8” iron rod set, for the most westerly northwest corner of this;

            THENCE S. 00 deg. 29’51” W., 125.00 feet, to a 3/8” iron rod set, for a corner of this;

            THENCE S. 19 deg. 53’01” E., 64.01 feet, to a 3/8” iron rod set, for a corner of this;

            THENCE S. 00 deg. 50’31” W., 457.41 feet, to the PLACE OF BEGINNING            containing 13.926 acres of land.

The bearings for the above description are based upon the south right of way of Osage road as described in the field notes prepared by Fred Williamson, being of record in Volume 288, Page 604, Deed Records of Coryell County, Texas.

Sec. 1-9.   Extraterritorial jurisdiction expanded.

            The extraterritorial jurisdiction of the city is hereby expanded to include the following real property:

Being 4.980 acres of land located in the Edward Norton Survey, Abstract No. 782, Coryell County, Texas.  Being part of the residue of 158.328 acre tract of land as described in a deed to Coryell Stoneridge Partners, L.C. from Jasper H. Arnold III, recorded in the Official Records, Document No. 86145, of Coryell County, Texas.  Said 4.980 acres being more particularly described by metes and bounds as follows:

            BEGINNING at a place out “X” in concrete and being the northwest corner of Lot 1, Block 2, of Stoneridge, Phase Two, a subdivision in the Edward Norton Survey, Gatesville, Texas, and recorded in Cabinet A, Slide 419 of the Plat Records of Coryell County, Texas.  Also being in the south margin of Greenlawn Drive, and being in the common line of the above-mentioned Stoneridge, Phase Two, and the residue of the above-mentioned 158.328 acres, marking the Point of Beginning and the northeast corner of herein-described tract;

            THENCE S. 00 deg. 50’31” W., (Base bearing, Stoneridge, Phase Two plat call) at 137.20 feet (plat call, 137.21 feet) pass a found 3/8” diameter rebar being the southwest corner of above-mentioned Lot 1, Block 2 and the northwest corner of Lot 10, Block 2, at 317.21 feet (plat call, 317.21 feet) pass a found 3/8” diameter rebar being the southwest corner of Lot 10, Block 2 and the northwest corner of Lot 11, Block 2, in all 335.46 feet along the common line of said Stoneridge, Phase Two and the residue of said 158.328 acres to a place ½” diameter rebar marking the most easterly southeast corner of herein-described tract;

            THENCE S. 89 deg. 03’48” W., 256.25 feet to a placed ½” diameter rebar marking an inside ell corner of herein described tract;

            THENCE S. 01 deg. 33’09” E. 325.69 feet to a placed ½” diameter rebar in the south line of the residue of said 158.328 acres and north margin of U.S. Highway No. 84 marking the most southerly southeast corner of  herein-described tract;

            THENCE N. 89 deg. 29’36” W., 60.04 feet to along the south line of the residue of said 158.328 acres and north margin of the above-mentioned U.S. Highway  No. 84 to a placed ½” diameter rebar marking the most southerly southwest corner of herein described tract;

            THENCE N. 01 deg. 33’09” W., 324.18 feet to a placed ½” diameter rebar marking an inside ell corner of herein-described tract;

            THENCE S. 89 deg. 03’48” W., 139.96 feet to a place ½” diameter rebar being the most easterly northeast corner of a called 4 acre tract of land as described in a deed to the Texas National Guard Armory Board, recorded in Volume 201, Page 362 of the above-mentioned Deed Records and being inside ell corner of the residue of said 158.328 acres and marking a corner in the south line of herein-described tract;

            THENCE S. 89 deg. 01’41” W., 115 feet (West 115.00 feet, Volume 201, Page 362) along the common line of above-mentioned 4 acres and the said 158.328 acres to a found 60d nail being an inside ell corner of said 4 acres and an outside ell corner of said 158.328 acres and marking the most westerly southwest corner of herein-described tract;

            THENCE N. 00 deg. 52’19” W., 311.96 feet (N. 00 deg. 06’00” E., 312.00 feet, Volume 201, Page 362) along a common line of said 4 acres and said 158.328 acres and to the southeast corner of a called 5.649 acre tract of land as described in a deed to C. Lynn Massingill, recorded in Volume 537, Page 559 of said Deed Records and marking a corner in the west line of herein-described tract;

            THENCE N. 00 deg. 17’ 09” W., 37.89 feet along the common line of the above-mentioned 5.649 acres and the residue of said 158.328 acres to a placed ½” diameter rebar marking the northwest corner of herein-described tract;

            THENCE N. 89 deg. 30’30” E., 581.03 feet to a placed cut “X” in concrete marking the Point of Beginning.

Being 11.48 acres of the Edward Norton Survey, Abst. No. 782 in Coryell County, Texas, and being part of a 158.328 acre tract of land described in a deed from Jasper H. Arnold, III to Coryell Stoneridge Partners, L.C., dated April 27, 1995, recorded as Document No. 86154 of the Official Public Records of Coryell County, Texas; said 11.48 acres being more particularly described as follows:

            BEGINNING at a ½ inch iron pin found in a fence on the west line of said 158.328 acre tract for the northwest corner of a 4.980 acre tract of land described in a deed to the City of Gatesville, Texas, recorded as Doc. No. 125881 of said Official Public Records, being on the east line of a 5.649 acre tract of land described in a deed to C. Lynn Massingill as recorded in Vol. 537, Page 559 of said Official Public Records;

            THENCE North 00 deg. 06’25” East, with the east line of said 5.649 acre tract and the fenced west line of said 158.328 acre tract, 29.92 feet to a 3/8 inch iron pin found for the northeast corner of said 5.649 acre tract and the southeast corner of a 3.50 acre tract of land described in a deed to Bradley M. Harris, Sr., et ux, recorded as Document No. 121469 of said official public records;

            THENCE North 00 deg. 01’25” East, with the east line of said 3.50 acre tract and the fenced west line of said 158.328 acre tract, 313.39 feet to a ½ inch iron pin set, from whence a 3/8 inch iron pin found for the northeast corner of said 3.50 acre tract brs. North 00 deg. 01’25” East, 26.94 feet; and from the northeast corner of said 3.50 acre tract, a ½ inch iron pin found for the northwest corner of said 158.328 acre tract brs. North 00 deg. 00’20” East, 1094.71 feet;

            THENCE South 89 deg. 05’45” East, 902.65 feet to a ½ inch iron pin set;

            THENCE South 00 deg. 54’30” West, 117.98 feet to a ½ inch iron pin set;

            THENCE South 89 deg. 05’40” East, 181.26 feet to a ½ inch iron pin set;

            THENCE South 01 deg. 07’20” West, 60.00 feet to a 3/8 inch iron pin found for the northwest corner of Lot 1, Block 3 of Stoneridge, Phase Two, a subdivision recorded in Plat Cabinet “B”, Slide 419 of the Plat Records of Coryell County, Texas, being on the east line of Stoneridge Drive, from whence a 3/8 inch iron pin found for the northeast corner of said Stoneridge, Phase Two, brs. South 89 deg. 05’40” East, 149.01 feet;

            THENCE North 89 deg. 05’40” West, crossing said Stoneridge Drive, at 60.03 feet passing the northeast corner of Lot 8, Block 1 of said Stoneridge, Phase Two, continuing with the north line of said Lot 8 a total distance of 181.03 feet to a 3/8 inch iron pin found for the northwest corner of said Lot 8;

            THENCE South 00 deg. 54’30” West, with the west lines of Lots 8, 7, and 6 of said Block 1, 250.14 feet to a 3/8 inch iron pin found for the southwest corner of said Lot 6, being on the north line of Lot 4 of said Block 1;

            THENCE North 89 deg. 05’20” West, with the north line of Lots 4, 3, 2, and 1 of said Block 1, 335.03 feet to a 3/8 inch iron pin found for the northwest corner of said Lot 1;

            THENCE South 00 deg. 53’20” West, with the west line of said Lot 1, 125.05 feet to a 3/8 inch iron pin found for the southwest corner of said Lot 1, Block 1, being on the north line of Greenlawn Drive;

            THENCE South 19 deg. 21’30” East, with the west line of said Stoneridge, Phase Two, crossing said Greenlawn Drive, 64.07 feet to an “X” found chiseled in concrete on the south line of said Greenlawn Drive for the northeast corner of said 4.980 acre tract and the northwest corner of Lot 1, Block 2 of said Stoneridge, Phase two;

            THENCE North 89 deg. 05’50” West, with the north line of said 4.980 acre tract, 580.82 feet to the PLACE OF BEGINNING as surveyed on the ground on April 13, 2000, by Maples & Associates, Inc., and as shown on an accompanying plat of even survey date herewith.

Sec. 1-10. Extraterritorial jurisdiction expanded.

            The extraterritorial jurisdiction of the city is hereby expanded to include the following real property:

Field Notes for a 16.139 acre tract of land more or less out of the A. Arocha Survey, Abstract No. 8 located in Coryell County, Texas, being part of Gateway Subdivision, Coryell County, Texas of record in Cabinet A, Slide 99 of the Coryell County, Texas Plat Records and being more particularly described by metes and bounds as follows, bearing on plat calls:

BEGINNING at the northwest corner of Lot 1, Block 1 of the above mentioned Gateway Subdivision, the southwest corner of a called 1.004 acre tract of land as described in a deed to Cindy Long, of record in Instrument No. 892002 Coryell County Deed Records, the east line of a tract of land as described in a deed to Fabian John Klecka, Jr. of record in Volume 396, Page 348 of the above Coryell County, Texas Deed Records, and also in the east City Limits Line of the City of Gatesville, Coryell County, Texas as described in ordinance No. 94-12 of record in Instrument No. 88933 of said Deed Records, for the northwest corner of the herein described tract:

THENCE S 72˚31’40” E 1262.50 feet along the common lines of the above mentioned Cindy Long tract, a called 60.452 acre tract of land as described in a deed to Christopher Jason Long, of record in Instrument No. 145685 Coryell County Deed Records, and the said Gateway Subdivision to the northeast corner of Lot 1 Block 3 of said Gateway Subdivision, and in the west line of a called 9.73 acre tract of land as described in a deed to Gale Ussery and wife Susan Ussery of record in Instrument No. 139753 of the said Deed Records for the northeast corner of the here in described tract;

THENCE S 18˚28’20” W 598.60 feet along the common line of the above mentioned Ussery tract and the said Gateway Subdivision to the southeast corner of Lot 13, Block 7 of said Gateway Subdivision, a corner in the west line of said Ussery tract, and the northeast corner of the residue of a called 35.424 acre tract as described in a deed to Wise Family Limited of record in Instrument No. 102428 of said Deed Records, for the southeast corner of the here in described tract;

THENCE N 73˚07’50” W 798.60 feet and N 71˚37’00” W 198.00 feet along the common line of the above mentioned Wise Family Limited tract and the said Gateway Subdivision to the southwest corner of Lot 4 Block 7, southeast corner of Lot 3, Block 7, of said Gateway Subdivision, and in the above mentioned east City Limits Line, for the most southerly southwest corner of the here in described tract;

THENCE N 18˚28’20” E 125.00 feet (call N 18˚28’20” E 125.00 feet, Ordinance No. 94-12) along common lots line of above mentioned Lots 3 and 4, Block 7 said Gateway Subdivision, said east City Limits Line to the northeast and northwest corners of said Lots 3 and 4, Block 7 said Gateway Subdivision and the Line to the northeast and northwest corners of said Lots 3 and 4, Block 7 said gateway Subdivision and the south margin of Gateway Circle;

THENCE N 71˚37’00” W 176.99 feet (call N 72˚02’59” W 175.62 feet, Ordinance No. 94-12) along the south margin of Gateway Circle and said City Limits to a point:

THENCE N 19˚48’00” E 274.97 (call N 19˚04’34” E 274.59 feet, Ordinance 94-12) feet along the west margin of Gateway Circle, said City Limits, the west lines of Lots 1 and 2, Block 4 said Gateway Subdivision to the northeast corner of Lot 1, Block 4 of said Gateway Subdivision, and the south margin of Ash Drive as shown on said Gateway Subdivision;

THENCE N 71˚37’00” W 100.03 feet (call N 72˚13’26” W 99.98 feet, Ordinance No. 94-12) along the south margin of said Ash Drive, said City Limits, the north line of Lot 1, Block 4 of said Gateway Subdivision to its northwest corner, and being in the east line of the above mentioned Klecka tract;

THENCE N 19˚48’00” E 199.80 (call N 19˚09’10” E, Ordinance 94-12) feet along the common line of said Gateway Subdivision, said City Limits, and said Klecka tract to the POINT OF BEGINNING and containing 16.139 acres of land more or less.

Field Notes for a 22.015 acre tract of land more or less out of the A. Arocha Survey, Abstract No. 8 located in Coryell County, Texas, being part of Hamilton Estates Phase I, Coryell County, Texas of record in Cabinet A, Slide 211 of the Coryell County, Texas Plat Records, Hamilton Estates Phase II Coryell County, Texas (along with a 60 foot wide strip of land adjoining Tracts 13-21), of record in Cabinet A, Slide 255 of said Plat Records and Hamilton Estates Phase III Coryell County, Texas of record in Cabinet A, Slide 358 of said Plat Records and being more particularly described by metes and bounds as follows, bearing based on plat calls:

BEGINNING at a point in the common line of above mentioned Hamilton Estates Phase I, the south line of a tract of land as described in a deed to James Randolph Erwin, of record in Volume 486, Page 877 of the Coryell County Deed records, and also at an inside ell corner of the west City Limits Line of the City of Gatesville, Coryell County, Texas as described in Ordinance No. 94-12 of record in Instrument No. 88933 of said Deed records:

THENCE S 70˚56’56” E 10.72 (call N 71˚57’23” E 10.72 feet, Ordinance No. 94-12) feet along the common line of the north line of Tract 4 of the above mentioned Hamilton Estates Phase I, the south line of above mentioned James Randolph Erwin tract, and said City Limits Line to the northeast corner of Tract 4 and the northwest corner of tract 3 of said Hamilton Estates Phase I, for most northerly northeast corner of the here in described tract;
