REGULAR CITY COUNCIL MEETING

 

APRIL 10, 2012

 

5:30 P.M.

 

COUNCIL CHAMBER, 110 NORTH 8TH STREET

 

PRESENT:    Mayor Byrom, Council Members Chumley, Woodlock, Viss,  Shepherd- Cain, and Burrow  

 

REGRETS:  Council Member Ollie Inmon

 

OTHERS PRESENT:  City Manager Roger Mumby, Assistant City Manager Luis Lobo, City Secretary Wendy Cole, Larry Kennedy, Faye Nichols, Georgianna Cleverly, Nathan Gohlke, Darinda Crosby, Matthew Glover, Becky Foreman, and Michelle Fletcher

 

AN OPEN  MEETING WAS HELD CONCERNING THE FOLLOWING SUBJECTS

 

1)  CALL TO ORDER AT  5:35  P.M., THIS  10th  DAY OF  APRIL, 2012

 

2)  PROOF OF NOTICE AND POSTING OF COUNCIL MEETING AGENDA

 

Mayor David Byrom directed a question to  City Secretary Wendy Cole if the notice of the meeting was posted at proper place and time pursuant to the Texas Opening Meeting Act (Tex. Rev. Stat. Ann. Art. 6252-17) Vernon's Supp. 1990.  City Secretary Wendy Cole assured Mayor David Byrom the notice  was posted at the proper place and time.

3)  APPROVAL OF MINUTES FROM PREVIOUS MEETING

 

Motion by  Cain, seconded by Burrow, all voting "Aye" to approve Resolution Number 2012-35

 

RESOLUTION NUMBER 2012-35   -  approve Minutes of  March 27th  Regular City Council Meeting.

 

4)    RECOGNIZE EMPLOYEE OF THE MONTH

 

Mayor David Byrom congratulated  Officer Matthew Glover from the Gatesville Police Department as Employee of the Month for March 2012 and recognized him for his superior performance for the City of Gatesville.

 

5)   HEAR VISITORS

 

Visitors present were only concerned with an Agenda item.

 

6)    CONSIDER  PROCLAMATION DECLARING THE WEEK OF APRIL 8-14, 2012 AS “NATIONAL PUBLIC SAFETY  TELECOMMUNICATORS WEEK”

 

Mayor David Byrom presented the Proclamation declaring the week of April 8-14 2012 as “National Public Safety Telecommunicators Week”.  Becky Foreman and Michelle Fletcher who were representing the telecommunicators were invited to come forward and were congratulated by Mayor Byrom and presented the proclamation.  Police Chief Nathan Gohlke stated that on Thursday, April 12th the ten dispatchers were being recognized with a Bar-B-Q dinner at the Police Department.

 

Motion by  Chumley, seconded by Woodlock, all voting "Aye" to approve Resolution Number 2012-36

7)    CONSIDER  PROCLAMATION DECLARING APRIL 28, 2012  AS “DAY OF THE CHILD”

 

Mayor David Byrom presented the Proclamation declaring April 28, 2012 as “Day of the Child” to Exchange Club chairperson Darinda Crosby and club President Faye Nichols.

 

Motion by Viss, seconded by Cain, all voting "Aye" to approve Resolution Number 2012-37

 

RESOLUTION NUMBER 2012-37   -  approve Proclamation declaring April 28, 2012 as “Day of the Child”.

 

8)    CONSIDER CHANGING THE NAME OF THE COMPLEX FACILITY   

 

City Manager Mumby stated that since the ownership of the Coryell County Complex is being changed from Coryell County to the City of Gatesville the name should reflect the change of ownership.  City Manager Mumby encouraged the council members to present any suggestions for a new name.  There was a discussion and all the council members agreed that the new name should be the “Gatesville Civic Center”.

 

Motion by  Burrow, seconded by Viss, all voting "Aye" to approve Resolution Number 2012-38

 

RESOLUTION NUMBER 2012-38   -  approve the name: Gatesville Civic Center for the old Coryell County Complex property.

 

9)    CONSIDER REPLY TO CORYELL CITY WATER SUPPLY DISTRICT

 

City Manager Mumby discussed the letter that Coryell City Water Supply District sent to the City of Gatesville regarding changes they are requesting to their water supply contract.  City Manager Mumby spoke about the old contract, the contract that the City gave them to sign, and what would be in the new contract with what they requested.  The contract which the City sent out was not for renegotiating but to update the debt service on the eight million dollars worth of bonds.  None of the Water Supply Districts have taken exception to the debt service or the operation and  maintenance rates which are the key pieces to this contract.  If there were any questions from any of the water supply corporations at all it was concerning  the water quantities.

 

There was lengthy discussion concerning:

 

----  How much water the water supply corporations have access to in a year.

----  How the water quantities are figured.

----  Any overage of usage in a year’s time.

----  Quantity caps.

----  What TCEQ requires.

----  Penalties if the cap is exceeded.

----  Anticipated Growth.

----  Water Rights.

----  Sovereign immunity.

 

City Manager Mumby reported that all the water supply corporations have been paying the debt service rate and the 1.10 per thousand gallons for the last three months, so there is no problem with the City of Gatesville paying the first debt payment.  City Manager Mumby suggests that the council members approve the Coryell City Water Supply District’s request to adjust the water quantities and deny all the other requests presented in the letter.  Also recommended is to approve the reply letter to Coryell City Water Supply District as well as the new contract and authorize the Mayor to sign both.

 

Motion by Woodlock, seconded by Chumley, all voting "Aye" to approve Resolution Number 2012-39

 

RESOLUTION NUMBER 2012-39   -  approve the letter to Coryell City Water Supply District and the new water contract and authorize the Mayor to sign both.

 

10)  CITY  MANAGER’S REPORT

 

----  Title searches are being done on the six houses for the HOME program applicants.

----  The concrete for the T-Hangars has been poured.  Hopefully the hangars will be delivered next

        week.

 

----   The base work for the foundation for the pavilion at Faunt Le Roy Park is completed and should

         pour the concrete for the slab next week.

 

----   Should have the estimate for the asbestos removal and demolition costs at the next council meeting

        for the buildings on the 700 Block of Main Street.

 

----   The old warehouse building is now in the process of being torn down.

 

----   Have gotten bids for the materials to build the 9 hole disk golf course in Raby Park.

 

----   Discussed the handicapped lifts that will be ordered to go at the City pool and the Fitness Center. 

        One portable  one will be at the Fitness Center and two fixed ones at the City Pool.  They should be

        ordered this week and we will have them before the deadline.

 

----  Reported that Coryell County owns the Leon River Bridge and the City would like to put the new

       bridge where the old bridge is so no utilities would need to be moved.  The old bridge would be

       moved somewhere else since it is recognized by the historical commission.

 

----  Reported that the forty thousand dollar cost to the City for the Rotunda project would be in next

       year’s fiscal year budget.

 

----  Discussed the many options for the recycle program – both at the City Shop and curbside.  Also

       discussed educating the public about recycling and the cost of different  ways of recycling.
