REGULAR CITY COUNCIL MEETING

PRESENT:    Council Members Chumley, Woodlock, Viss, Inmon, Mayor Pro-Tem Shepherd- Cain, and Burrow

AN OPENING MEETING WAS HELD CONCERNING THE FOLLOWING SUBJECTS

 

1)  CALL TO ORDER AT 5:35 P.M., THIS  13th  DAY OF  MARCH, 2012

 

2)  PROOF OF NOTICE AND POSTING OF COUNCIL MEETING AGENDA

 

Mayor Pro-Tem Shepherd-Cain directed a question to  City Secretary Wendy Cole if the notice of the meeting was posted at proper place and time pursuant to the Texas Opening Meeting Act (Tex. Rev. Stat. Ann. Art. 6252-17) Vernon's Supp. 1990.  City Secretary Wendy Cole assured Mayor Pro-Tem Shepherd-Cain the notice  was posted at the proper place and time.

3)  APPROVAL OF MINUTES FROM PREVIOUS MEETING

 

Motion by Viss, seconded by Burrow, all voting "Aye" to approve Resolution Number 2012-22

 

RESOLUTION NUMBER 2012-22   -  approve Minutes of  February 28, 2012 Regular City Council Meeting.

 

4)    RECOGNIZE EMPLOYEE OF THE MONTH

 

Mayor Pro-Tem Shepherd-Cain congratulated Jeremy Clawson from the Wastewater Department as Employee of the Month for February 2012 and recognized him for his superior performance for the City of Gatesville.

 

5)   HEAR VISITORS

 

Visitors present were only concerned with an Agenda item.

 

6)   CONSIDER THIRD AND FINAL READING OF ORDINANCE NUMBER 2012-01 AMENDING CHAPTER 15, PARKS, RECREATION AND  CULTURAL FACILITIES BY CHANGING THE PER DAY FEE FOR RV AND TENT FEES

    

City Manager Mumby stated no changes had been made to this ordinance since the previous readings and he recommended approving the ordinance.

 

Motion by Woodlock, seconded by Viss, all voting "Aye" to approve Resolution Number 2012-23

 

RESOLUTION NUMBER 2012-23   -  approve Ordinance Number 2012-01 on the third and final reading amending Chapter 15, Parks, Recreation, and Cultural Facilities by changing the per day fee for Recreational Vehicles and Tent Fees.

7)   CONSIDER THIRD AND FINAL READING OF ORDINANCE NUMBER 2012-02 TO CHANGE ZONING OF LOT 1, BLOCK1 AND LOTS 1  THROUGH LOT 11, BLOCK 2 OF THE CANYON CROSSING SUBDIVISION PLAT FROM RESIDENTIAL SINGLE FAMILY TO 2-4 FAMILY  ZONING DISTRICT

 

City Manager Mumby stated no changes had been made to this ordinance since the previous readings.   Mumby also said that there still has been no comments from any residents in the area.  City Manager Mumby recommended approving the ordinance.

 

Motion by Burrow, seconded by Chumley, all voting "Aye" to approve Resolution Number 2012-24

 

RESOLUTION NUMBER 2012-24   -  approve Ordinance Number 2012-02 on the third and final reading to change zoning of Lot 1, Block 1 and Lots 1 through Lot 11, Block 2 of the Canyon Crossing Subdivision Plat from Residential Single Family to 2 to 4  Family Zoning District. 

 

8)    CONSIDER REPLAT REQUEST OF LOTS 32 AND 33 BLOCK 1, CEDAR MOUNTAIN ESTATE, CORYELL COUNTY, TEXAS

 

Zoning Official Shauna Latham explained that this replat request is located across from the Hughes Unit.  Ms. Latham stated that it is not in the City limits but is in the City of Gatesville’s Extraterritorial Jurisdiction (ETJ).  This property is owned by Rafael and Diana Medina and Jerry and Linda Koch.  Chris Aiken is attempting to buy this land and is requesting the replat because it was never replatted and filed with the court system at the Courthouse by the owners as required.  Mr. Aiken is in the process of purchasing a piece of property from one of these individuals.  The bank won’t approve Mr. Aiken’s application for the loan request because this property hasn’t been replatted.  Ms. Latham discussed the plat included in the council book and also informed the Council that this was presented to and approved by the Planning and Zoning Board.  Ms. Latham recommended that this be approved by the Council so Mr. Aiken can purchase this property.

 

Motion by Chumley, seconded by Woodlock, all voting "Aye" to approve Resolution Number 2012-25

 

RESOLUTION NUMBER 2012-25   -  approve the replat request of Lots 32 and 33 Block 1, Cedar Mountain Estate Coryell County, Texas.

 

9)    CONSIDER DESIGNATING THE USE OF 80% OF THE HOTEL/MOTEL TAX FUNDS

 

City Manager Mumby explained that the 80% of the Hotel/Motel Tax funds available to be used by the City of Gatesville is approximately seventy thousand dollars this year.  He recommended these funds be used for the Fourth of July concert and fireworks show, the Summer in the Park Concert Series, and repairs and renovation of the City Auditorium.  City Manager Mumby stated that the advice from Texas Municipal League (TML) regarding how to spend these funds is only guidance and not directive.  City Manager Mumby explained that TML’s guidelines are too restrictive and would make the using of these funds nearly impossible.  The Texas Comptroller sets the requirements of expenditure of Hotel/Motel funds and if the comptroller ever requested the City of Gatesville to justify how these funds were spent the City could show all details and feel very comfortable about all projects these funds were used on.   City Manager Mumby and council members further discussed the details of the different projects and City Manager Mumby recommended designating the 80% to be used as indicated.  If another project ever came up during the year it would be presented to the City Council to be considered.

 

Motion by Inmon, seconded by Chumley, all voting "Aye" to approve Resolution Number 2012-26

 

RESOLUTION NUMBER 2012-26   -  approve designating the use of 80% of the Hotel/Motel Tax Funds. 

 

10)   CONSIDER 20% HOTEL/MOTEL TAX AWARD

 

City Manager Mumby explained that in March of every year the City receives proposals from various organizations requesting financial support from a portion of the Motel/Hotel Tax funds the City collects from the prior year.  Based on input from the last few years the City will possibly look at raising the support to 70%/30% next year since it is hard to stay within the 20% guideline.  City Manager Mumby presented the requests from the seven organizations and indicated how each advertised the City of Gatesville and promoted tourism.

These proposed awards go over approximately fifteen hundred dollars of what the City suggests to award and City Manager Mumby recommends taking the additional amount out of the 80%.

 

Mayor Pro-Tem Shepherd-Cain pointed out that the Shivaree, Spurfest, and Cruzin’ Cruzers were combining events so she asked Executive Chamber of Commerce Director Susie Gunnels to present additional details.  Ms. Gunnels reported that moving the Shivaree to September 14-16 from June will make a huge difference regarding the weather.  Also clustering these three events together will expand this to be big weekend event.  The Chamber feels this effort will make a difference so out-of-town people might decide to spend the night in a hotel which would promote Gatesville.  Ms. Gunnels thanked the Council for past and present support and wanted the Council to know the Chamber greatly appreciates the City of Gatesville.

 

City Manager Mumby recommended approving the awards as indicated and will present any other organizations or requests to the Council if they come up during the year.

Motion by Chumley, seconded by Burrow, all voting "Aye" to approve Resolution Number 2012-27

 

RESOLUTION NUMBER 2012-27   -  approve the 20% Hotel/Motel Tax Awards.

 

11)   CONSIDER APPROVAL OF THE 2012-2013 BUDGET CALENDAR

 

Assistant City Manager Luis Lobo introduced the tentative Fiscal Year 2012-2013 Budget Calendar.  Discussed was the Goal Setting Session, Budget Workshop, deadlines, and the certified tax roll from the County.

 

City Manager Mumby explained that this orderly Budget process gives the Council and department heads plenty of time to give input and work out the budget.  He also said the Goal Setting Session is where the City proposes what the staff thinks the priorities are for developing this year’s budget.  This Budget Calendar  is essentially the same as last years.

 

Motion by Viss, seconded by Burrow , all voting "Aye" to approve Resolution Number 2012-28

12)   CONSIDER AUTHORIZING CITY STAFF TO REQUEST PROPOSALS FOR A BANK DEPOSITORY

 

Assistant City Manager Luis Lobo stated that the agreement between Texas First State Bank and the City of Gatesville as the City’s bank depository is coming to an end.  The City staff is seeking authorization from the Council to get proposals from bank institutions to service as the City of Gatesville’s bank depository.  The proposals would consist of a three year agreement with a two year extension exercised by the City based upon performance.

 

Motion by Burrow, seconded by Woodlock, all voting "Aye" to approve Resolution Number 2012-29

 

RESOLUTION NUMBER 2012-29   -  approve authorization for the City staff to request proposals from banking institutions to serve as the bank depository for the City of Gatesville.

13)  CITY MANAGER’S REPORT

 

----  Reported about the two day class the City conducted regarding Customer Service training with the

       staff  last week.  The class reinforced with the City staff that quality customer service is very

       important.

 

----  Received a draft today presenting a resolution that would propose trading the Foxworth-Galbraith

       property for the Coryell County Complex Building.  There are a few things to work out, but it looks

       like there will be a proposal for the Council at the next meeting on March 27th to execute the trade.

 

----  Discussed that Main Street has no sidewalks but reported that the sidewalks are provided by the

       State of  Texas.

 

----  Discussed the airport terminal, L-3, T-Hangars, the Ramp Grant Program, and the plan to extend the

       runway.

 

----  Reported that the Military Appreciation Fish Fry at the Complex was a huge success with about 400

       people in attendance.

 

----  Planning to pave Bridge Street down to the split on Golf Course Road when the weather warms up

        so the asphalt won’t get too cold since the City does not have a lay down machine.

 

----  Discussed a junk yard at a house on Golf Course Road and it has already been reported to Robert.

 

----  Discussed condemned properties on Bridge Street and Main Street.

 

----  Reported that City Code Enforcement Officer Robert Featherston is working on a guideline for

       demolition permits.

 

----  Mayor Pro-Tem Shepherd Cain commented that the seminar she attended in San Antonio was very

        informative and it clarified to her that the City of Gatesville is doing things right.
