          REGULAR  CITY COUNCIL MEETING

 

JUNE 14, 2011

 

5:30 P.M.

 

  COUNCIL CHAMBER, 110 N. 8th STREET

 

 

PRESENT:  Mayor Byrom, Council Members Woodlock, Knox, Chumley, Cain, and Inmon

 

ABSENT:  Council Member Wasson

 

OTHERS PRESENT:  City Manager Roger Mumby, Assistant City Manager Luis Lobo, Shauna Latham, Liz Rienhardt, George Fox, Chief of Police Nathan Gohlke, Bobby Buster, Alfredo Herrera

 

AN OPENIG MEETING WAS HELD CONCERNING THE FOLLOWING SUBJECTS

 

1)    CALL TO ORDER AT 5:30 P.M. THIS 14TH DAY OF JUNE, 2011

 

2)    PROOF OF NOTICE AND POSTING OF COUNCIL MEETING AGENDA

 

Mayor Byrom directed a question to Assistant City Manager Luis Lobo if the notice of the meeting was posted at proper place and time pursuant to the Texas Opening Meeting Act (Tex. Rev. Stat. Ann. Art. 6252-17) Vernon's Supp. 1990.  Assistant City Manager Lobo assured Mayor Byrom that the notice was posted at the proper place and time.

3)   APPROVAL OF MINUTES FROM THE PREVIOUS MEETING

 

Motion by Inmon, seconded by Woodlock, all voting "aye" to approve Resolution Number 2011-48

 

RESOLUTION NUMBER 2011-48-- approve minutes of May 10, 2011

 

4)    Recognize Employee of the Month

 

Robert (Bobby) Buster was recognized as Employee of the Month.  He is a Wastewater Plant Operator.

 

5)    Hear Visitors

 

No one approach the council.

           

6)    Hear Presentation on Feral Cat Management Program  

 

George Fox made a presentation to the council with a proposed program to help the problem of "feral" cats in Gatesville.  Fox explained the proposed program would concentrate on the capture and spading of feral cats.  This program would be operated by volunteers.  The feral cat program would work in conjunction with the Gatesville police department animal control operations.

 

City Manager Mumby asked how the program would be funded.

 

Fox response was that fund raisers would be conducted by the volunteers and some city support.

Council member Knox asked about training for the volunteers.

 

Fox stated volunteers would be trained by members that run the Killeen area program for feral cats.

 

Police Chief Gohlke informed the council that he support the proposed program as presented by Fox. Gohlke told the council he thought we should try the program.

 

7)   CONSIDER ACCEPTANCE OF TEXAS-NEW MEXICO POWER APPLICATION  TO DEPLOYAN ADVANCE METERING SYSTEM

 

Assistance City Manager Lobo presented the council with the proposed settlement between Texas-New Mexico Power and a coalition of seventeen cities.  The proposed settlement is to be presented to the Public Utility Commission.  Alfredo Herrera, with Herrera & Boyle law firm, explained to the city council their work representing the coalition of cities and TNMP.  The advance metering system would be funded but at a lower rate to customers of TNMP.

     

8)  CONSIDER A REPLAT REQUEST OF .624 ACRES BEING THE SOUTHERN PART OF LOT 7, BLOCK 19 OF THE SOUTHEASTERN ANNEX BEING LOCATED IN THE 100 BLOCK OF SURREY LANE

 

Motion by Cain seconded by Chumley, all voting "aye" to approve Resolution Number 2011-49

 

RESOLUTION NUMBER 2011-49-- approve request to re-plat  .624 acres being the Southern part of Lot 7, Block 19 of the Southeastern Annex being located in the 100 block of Surrey Lane

 

9)  CONSIDER A RESOLUTION APPROVING ARROWHEAD SUBDIVISION PLAT PHASE I

 

Motion by Knox, seconded by Cain, all voting "aye" to approve Resolution 2011-50

 

RESOLUTION NUMBER 2011-50-- approve Arrowhead Subdivision Plat Phase I

 

10)  CONSIDER A RESOLUTION APPROVING BROWN ADDITION SUBDIVISION

 

This issue has been tabled.

       

11)   CONSIDER RE-APPOINTMENT OF TWO HOUSING AUTHORITY BOARD MEMBERS

 

Motion by Knox, seconded by Chumley, all voting "aye" to approve Resolution Number 2011-51

 

RESOLUTION NUMBER 2011-51-- approve the appointment of Bob Edwards and Bill Truss to the Gatesville Housing Authority board.

 

12)  CONSIDER APPROVAL OF PAY REQUEST FROM K & S BACKHOE FOR THE TDCJ WATER METER PROJECT

 

City Manager Mumby informed the council that this project is complete.  All costs of this project are to be paid by the Texas Department of Criminal Justice.

 

Motion by Knox, seconded by Woodlock , all voting "aye" to approve Resolution Number 2011-52

 

RESOLUTION NUMBER 2011-52-- approve the pay request from K & S Backhoe for the installation of a water meter to the Texas Department of Criminal Justice.

13)   RECESS REGULAR MEETING AND CALL AN EXECUTIVE SESSION

 

CLOSED MEETING

 

This closed meeting is in accordance with Government Code 551.074 – Personnel Matters – City Attorney and Municipal Court Judge Annual Performance Evaluation

 

14)   END CLOSED SESSION AND RECONVENE REGULAR MEETING

 

15)   CONSIDER ANY ACTION FROM EXECUTIVE SESSION CONCERNING PERSONNEL MATTERS--CITY ATTORNEY AND MUNICIPAL COURT JUDGE ANNUAL PERFORMANCE EVALUATION

 

Motion by Knox, seconded by Cain, all voting "aye" to approve Resolution Number 2011-53

 

RESOLUTION NUMBER 2011-53-- to approve a five percent (5%) pay raise for the City Attorney and Municipal Court Judge

 

16)  City Manager’s Report 

 

City Manager Mumby--

 

            Legal papers concerning the Animal Control shelter are complete and the city will move             on forward on this project

            On June 25, 2011 the City of Gatesville will host a Hazardous Waste Day.  Persons may           deliver hazardous waste at the Foxworth-Galbraith Lumber site
