REGULAR CITY COUNCIL MEETING

 

MAY 28, 2013

 

5:30 P.M.

 

COUNCIL CHAMBER, 110 NORTH 8TH STREET

 

PRESENT:       Mayor Byrom, Council Members, Chumley, Inmon, Viss,  Burrow and

Shepherd-Cain

AN OPEN  MEETING WAS HELD CONCERNING THE FOLLOWING SUBJECTS

 

1)  CALL TO ORDER AT  5:30  P.M., THIS 28th  DAY OF  MAY, 2013

 

2)  PROOF OF NOTICE AND POSTING OF COUNCIL MEETING AGENDA

 

Mayor Byrom directed a question to  City Secretary Wendy Cole  if the notice of the meeting was posted at proper place and time pursuant to the Texas Opening Meeting Act (Tex. Gov’t. Code Chapter 551, Sec. 551.041)  City Secretary Wendy Cole  assured Mayor Byrom  the notice  was posted at the proper place and time.

3)  APPROVAL OF MINUTES FROM PREVIOUS MEETING

 

Motion by  Burrow, seconded by Inmon, all voting "Aye" to approve Resolution Number 2013-70

 

RESOLUTION NUMBER 2013-70      -  approve Minutes May 14, 2013 Regular City Council Meeting.

 

4)    HEAR VISITORS

 

Visitors present were only concerned with an Agenda item.

 

5)    CONSIDER APPROVAL OF FY  2011-2012 AUDIT

 

Auditor, Dane Legg from Lott, Vernon and Company, Certified Public Accountants, introduced himself to the Council to present an overview of the City’s audit of financial statements.  Janet Stephenson from Lott, Vernon and Company was also present to assist Mr. Legg with any concerns or questions the City Council might have.  Mr. Legg presented each council member with a financial report and then proceeded to discuss the audit in more detail.  Mr. Legg stated that the City received an unqualified opinion which is what all Cities strive for.  Differences between last year’s audit and this year’s audit plus changes that needed to be made were also discussed.  After many questions from the Mayor, City Manager, and Council there was a recommendation to accept the fiscal year 2011-2012 audit.

 

Motion by Shepherd-Cain, seconded by Burrow, all voting “Aye” to approve Resolution Number 2013-71

6)    RECOGNIZE AND PRESENT EXITING PLANNING AND ZONING COMMITTEE MEMBERS WITH PLAQUES OF  APPRECIATION

 

Mayor David Byrom presented plaques of appreciation to departing Planning and Zoning Committee members Sharon Meharg who served for four years and Zach Chumley who served for a little over one year.  Mayor Byrom thanked them for their valuable service to the City of Gatesville and their citizens.

 

7)    CONSIDER PLAT AMENDMENT REQUEST FROM PROPERTY OWNER, SHANNON BLAKELY, REGARDING THE WEST HALF  LOT 5 AND LOT  4, BLOCK 6, POLLARD ADDITION

 

City Manager Roger Mumby explained to the Council that this agenda item would need to be passed to the next Council Meeting because it was put on the agenda prematurely.  The process is not complete as it still needs to go before the Planning and Zoning Committee.

 

8)   CONSIER APPROVAL OF THE SECOND READING OF  ORDINANCE NUMBER 2013-09  AMENDING  CHAPTER 3, SECTION 304, BUSINESS GROUP B  OF THE INTERNATIONAL BUILDING CODE 2012

City Manager Roger Mumby stated that there has been no change to this proposed ordinance since the previous reading and recommended approval of this second reading of Ordinance Number 2013-09.  Mayor Byrom asked if there was any further discussion after the motion by Councilmember Shepherd-Cain and second by councilmember Burrow and there were no comments.

 

Motion by Shepherd-Cain, seconded by Burrow,  Chumley, Inmon, Shepherd-Cain, Burrow voting “Aye” to approve Resolution Number 2013-72.  Viss voting “Nay”.

 

RESOLUTION NUBMER 2013-72  -  approve second reading of Ordinance Number 2013-09 amending Chapter 3, Section 304, Business Group B of the International Building Code 2012.

 

9)   CONSIDER APPROVAL OF PAYMENT REQUEST #9 FROM NATGUN FOR THE STORAGE TANK IMPROVEMENT PROJECT    

 

City Manager Roger Mumby told the Council that the landscaping and fences are all that is left to be completed on this project and that the next pay request should be the last one, after a final inspection.  Mr. Mumby recommended approval for this Pay Request #9 from Natgun in the amount of $219,103.43.

 

Motion by Burrow, seconded by Chumley, all voting “Aye” to approve Resolution Number 2013-73

 

RESOLUTION NUMBER 2013-73   -  approve Payment Request #9 from Natgun for the Storage Tank Improvement Project in the amount of $219,103.43.

 

10)   CONSIDER APPROVAL TO AMEND THE BYLAWS OF THE GATESVILLE ECONOMIC DEVELOPMENT BOARD

      

City Manager Roger Mumby reminded the Council that when this organization was formed last year a position was approved for a member from the Planning and Zoning  (P& Z) Committee to serve on the Gatesville Economic Development Board (GEDB).  Gatesville Economic Development Board member Barbara Burrow explained that the Board has been trying to replace Christina Coleman who resigned because she had over extended herself.  The other Planning and Zoning Board members are also unable to serve so it is recommended that the Planning and Zoning position be amended to be an “At Large” position.  This would make three “At Large “ persons.

 

Motion by Shepherd-Cain, seconded by Inmon, all voting “Aye” to approve Resolution Number 2013-74

 

RESOLUTION NUMBER 2013-74  -  approve an amendment to the Bylaws of the Gatesville Economic Development Board to change the Planning and Zoning position member to an “At Large” membership that lives within the city limits of Gatesville.

 

11)    FIRE DEPARTMENT REPORT

 

Fire Chief Billy Vaden discussed the Fire Department Report which was included in the Council book.

12)    POLICE DEPARTMENT REPORT

 

Police Chief Nathan Gohlke presented the Police Department Report.  Chief Gohlke also announced that a new police officer  has been hired and he has five years of experience.  His name is Daniel Devall.  Also, the plan with Gatesville Independent School District to hire a police officer for security at school campuses is nearly finalized and will be included in the budget.  The mobile CADS are up and running in the police cars.

 

13)    CODE ENFORCEMENT AND BUILDING PERMIT REPORT

 

City Manager Roger Mumby told the Council that Code Enforcement Officer Liz Reinhardt had a death in family and so is not here to discuss the building permit report.  The report is included in the Council book and Mr. Mumby asked if there were any questions and there were none.

 

14)    UTILITY DEPARTMENT REPORT

 

Water Production Superintendent Berry Mansell presented the Utility Report and said that with the recent rains that the lakes are up 1 ½ feet.  He also discussed the chlorine burn that the City has been conducting the last month.  He discussed the details of the burn which basically “bleaches” the inside of the water pipes of the bio film/mass that  coats the inside of the pipes which in turn prevents the “brown”  water that used to occur every summer.  All has gone well and there have been no complaints from the public that the staff is aware of.

15)  CITY ATTORNEY REPORT

 

City Attorney Sandy Gately’s report was included in the council book and there were no questions.  Councilmember Viss thanked Sandy Gately for all her work on the ordinance book.

 

Councilmember Burrow commented that she hoped the zoning book would be updated next.

 

16)  CITY MUNICIPAL JUDGE REPORT

 

City Municipal Judge Tonya Place’s report was included in the council book and there were no questions.

 

17)   ECONOMIC DEVELOPMENT BOARD REPORT

 

The Economic Development Board report was included in the council book and there were no questions.

 

18)  CITY  MANAGER’S REPORT

 

City Manager Roger Mumby updated the Council on the following:

 

---  The City did not get funded for the asbestos removal at the rotunda so now the plan is to include it in

      the budget goal setting session to try to fund the asbestos abatement out of the Rotunda in a four or

      five year period.

 

---  The Community Development Block Grant scoring for  the 2013-2014 application was received this

      week and the City ranked number nine.  In the past the funding was awarded to the first eight

      grantees, so if the funding is the same the City probably won’t be funded this year.  The biggest

      reason is probably because the City was funded last year.

 

---  This Saturday, June 1st    is Spring Clean-Up at the Civic Center from 8:00 a.m. to 2:00 p.m.

 

---  The Civic Center renovation plan is still being developed and the recommendation for consideration

      will be presented to the council in June.   Timing to complete this project be a huge decision because

      the Civic Center will probably be out of commission for six to nine months which will interfere with

      citizens rental of  the building.

 

---  The fence at the library will be put back up because of the height of the building and the distance to

      the street.  The library is very close to being completed and there is a dedication ceremony on June

      21st at 5:00 p.m.

---  Still working with Fort Hood on developing the Memorandum of Understanding to transport the

      City’s recycle materials to the North Fort Hood collection point.  This will include tires also.

 

---   All the emergency alert sirens scattered around the City are all fixed and working and will be tested

       next Tuesday, weather permitting.

 

---  Councilmember Viss visited the airport terminal and was very impressed.  Mr. Mumby said that

      once it is completed there will be a grand opening.

 

---  Councilmember Shepherd-Cain said that a citizen reported to her that the trees in Raby park needed

      trimming.  Mr. Mumby reported that some dead trees were taken out last week.

 

---  Councilmember Chumley discussed Waste Management missing the last few Mondays picking up

      Garbage on Surry Lane and around the golf course.  Mr. Mumby said that he has spoken to Waste

      Management about this and the problem  should be resolved.  The trash workers were claiming that

      the truck was full and coming back the  next morning to pick up.  All trash pickup should now be

      completed in one day.

 

---  Councilmember Burrow reported that the Central Texas Sustainable Communities Partnership

      Committee which deals with recycling has an opening for a representative from Gatesville.  If

      anyone  is interested or know anyone that might be interested can talk to Liz Reinhardt the City’s

      Zoning Official.
