REGULAR CITY COUNCIL MEETING

 

SEPTEMBER 10, 2013

 

5:30 P.M.

 

COUNCIL CHAMBER, 110 NORTH 8TH STREET

 

PRESENT:       Mayor Byrom, Council Members, Viss, Burrow, Shepherd-Cain, Woodlock, Chumley and  Inmon  

 

OTHERS PRESENT:  City Manager Roger Mumby, Assistant City Manager Luis Lobo, City Secretary Wendy Cole,  Larry Kennedy, City Attorney Sandy Gately, Brenda Kiphen, Fred Weaver, Faye Nichols, Berry Mansell, Nathan Gohlke, Sam Cockrell, Robert Featherston, Jim Shepard, Rodney Murry, and Patrice Gilbert

 

AN OPEN  MEETING WAS HELD CONCERNING THE FOLLOWING SUBJECTS

 

1)  CALL TO ORDER  AT  5:30  P.M., THIS  10th  DAY OF  SEPTEMBER, 2013

 

2)  PROOF OF NOTICE AND POSTING OF COUNCIL MEETING AGENDA

 

Mayor Byrom directed a question to  City Secretary Wendy Cole  if the notice of the meeting was posted at proper place and time pursuant to the Texas Opening Meeting Act (Tex. Gov’t. Code Chapter 551, Sec. 551.041)  City Secretary Wendy Cole  assured Mayor Byrom the notice  was posted at the proper place and time.

3)  APPROVAL OF MINUTES FROM PREVIOUS MEETING  

 

Motion by Inmon, seconded by Shepherd-Cain, all voting "Aye" to approve Resolution Number 2013-108

 

RESOLUTION NUMBER 2013-108         -  approve Minutes August 27, 2013 Regular City Council Meeting and Special Council Minutes August 30, 2013.

 

4)    RECOGNIZE EMPLOYEE OF THE MONTH

 

Mayor David Byrom congratulated City Inspector Robert Featherston, for being selected as Employee of the Month for August 2013.  Mayor Byrom thanked Robert for everything he does on a daily basis to make Gatesville a great place to live and work.  Mayor Byrom recognized Robert for his superior performance.

 

5)    HEAR VISITORS:

 

Visitors present were only concerned with an Agenda item.

 

6)    APPROVE THIRD AND FINAL READING OF ORDINANCE NUMBER 2013-11 TO INCREASE THE CITY OF GATESVILLE RETAIL WATER RATES

 

City Manager Roger Mumby said that this is the  third and final reading to increase the City of Gatesville’s  retail water rates and there have been no changes since the first two readings.  This increase in water rates will begin October 1, 2013 and is recommended for approval.

 

Motion by Burrow, seconded by Chumley, all voting “Aye” to approve Resolution Number 2013-109

 

RESOLUTION NUMBER 2013-109  -  approve the third and final reading of Ordinance Number

2013-11  to increase the City of Gatesville retail water rates.

7)   CONSIDER APPROVAL OF ORDINANCE NUMBER 2013-12 ON AN EMERGENCY CLAUSE ADOPTING A TAX RATE OF $.41 PER $100 VALUATION TO SUPPORT THE 2013/2014 BUDGET

   

City Manager Mumby recommended approval of this Ordinance Number 2013-12 on an emergency clause adopting the tax rate of $.41 per $100 valuation.  Mr. Mumby explained that this ordinance can be approved as an emergency if all the council members are present.

 

Motion by Shepherd-Cain, seconded by Woodlock, all voting “Aye” to approve Resolution Number 2013-110

 

RESOLUTION NUMBER 2013-110   - approve Ordinance Number 2013-12 on an emergency clause adopting a tax rate of $.41 per $100 valuation to support the 2013/2014 budget.

 

8)   CONSIDER ADOPTING THE 2013/2014 FISCAL YEAR BUDGET FOR THE CITY OF GATESVILLE     

 

City Manager Mumby commended the Council and the City Staff on this budget development process.  Mr. Mumby said the Department Heads were present at this  meeting since it is the final portion of the budget process before it is adopted.  Mr. Mumby discussed a few budget adjustments made based on City Council input.  The 2013/2014 budget is balanced with some additional funds available based on the water rate increase and is recommended for adoption.

 

Motion by Chumley, seconded by Burrow, all voting “Aye” to approve Resolution Number 2013-111

 

RESOLUTION NUMBER 2013-111   -  approve adoption of the 2013/2014 Fiscal Year Budget for the City of Gatesville.

 

9)    CONSIDER SELLING THE FORT GATES FIRE STATION BUILDING

 

City Manager Roger Mumby said that there have been several inquiries about the possibility of selling the Fort Gates Fire Station.  Mr. Mumby stated that the City can sell real estate only by advertising for sealed bids and the city can reject any or all bids.  Mr. Mumby said that a commercial appraisal would need to be done to determine the value of the property prior to advertising it.

 

Fire Chief Billy Vaden was present at the meeting and the Council asked for his opinion on selling the Fire Station.  Chief Vaden said that he is not opposed to selling but that the station is used for storage for the Fire Safety House and a FEMA trailor.  He requests that if it would sell he would like to have storage incorporated onto the existing Fire Station Building.  Councilmember Burrow asked if there would be loss of services and Chief said no.  Also discussed was if Gatesville would ever need this for an additional station and Chief said that maybe many years away but even then the current location of this Fire Station would not be ideal.  There was further discussion regarding a mutual aid agreement with the North Fort Hood Fire Department, the cost of adding storage to the existing fire station and any deed restrictions on the Fort Gates Fire Station building.   After further discussion it was recommended to approve a commercial appraisal and then advertise for sealed bids.

 

Motion by Viss, seconded by Burrow, all voting “Aye” to approve Resolution Number 2013-112

 

RESOLUTION NUMBER 2013-112    - approve a commercial appraisal for the Fort Gates Fire Station and authorize the City Manager to advertise for sealed bids.

 

10)    CITY MANAGER’S  REPORT

 

City Manager Mumby’s report was included in each Council Member’s book and he asked if anyone had any questions.

 

---  Councilmember Viss asked when the Civic Center Task Force will meet again.  Mr. Mumby said 

      that he is waiting on numbers from Bert Moffitt of Grimes and Associates regarding the Civic Center

      recommendation and then the Task Force will meet again.  The actual renovations are probably still

      a year off.

---  Councilmember Shepherd-Cain asked Police Chief Gohlke to investigate an animal abuse situation

      regarding kittens on North Lutterloh.

 

---  Councilmember Burrow asked about the status of the recycling.  Mr. Mumby said the city is hauling

      about five thousand pounds a month to North Fort Hood.  He reported that the signs are clearly

      marked at the recycle site regarding what is permissible but we might update the city’s flyer to keep

      the public informed.

 

---  There was a discussion on the status of the Leon River Bridge.

 

---  Mr. Mumby said that the Old Gatesville High School Gym has now been torn down and people are

      still getting lumber from the piles.  The City will clean up the area after the public is through

       removing lumber.
